E-Prescribing UPDATE: Licensure Boards Provide Guidelines, Compliance Information and Waiver or Extension Options

Signed into law in 2018, HB2931 requires all physicians with prescriptive authority (other than veterinarians) to send all Schedule II-V prescriptions electronically. Physicians who meet certain criteria may apply for WAIVER or EXTENSION available from the Oklahoma Medical Licensure Board and the Oklahoma State Board of Osteopathic Examiners for physicians who meet certain criteria. Oklahoma State Board of Pharmacy Confirmation: Upon receipt of a valid Schedule II opioid prescription, a pharmacist shall fill the prescription to the specified dose, and shall not be permitted to fill a different dosage than what is prescribed.  However, the pharmacist maintains the right not to fill the valid opioid prescription.

  • This only applies to Schedule II Opioids.
  • After consultation with the Oklahoma Bureau of Narcotics and Dangerous Drugs (OBNDD), this statute is interpreted to mean that a Pharmacist cannot dispense any quantity other than what is designated on the prescription; OBNDD interprets this to include partial filling of any Schedule II Opioid prescription.
  •  In order to dispense a lesser than prescribed quantity, a new prescription must be obtained.

PRESCRIPTION PADS

In the instance of temporary technical or electrical failure, or if a waiver/extension has been approved by their Licensure Board, physicians may use a state-approved prescription pad to prescribe Schedule II-V substances. These pads will be shipped to you by the Oklahoma Bureau of Narcotics and Dangerous Drugs (OBNDD) in late November or early December. Each physician who has a Drug Enforcement Administration (DEA) registration number with OBNDD will receive one (1) pad that includes 100 prescription sheets. 

The pads will be sent to the physician’s OBNDD registered address, which may or may not be the same as their address with their licensure board. Additional pads, as needed, will be able to be requested through the OBNDD website (turn-around time is expected to be approximately 8 days…weather permitting).
